TERMS AND CONDITIONS OF SALE
The bidder must register to participate in the auction. Any bid made without proper registration will be invalid.
Tag Flow Auctions reserves the right to refuse participation without the necessity of furnishing any reasons.
All bids will attract a 15% buyer’s commission fee plus VAT on commission.
Every bid shall constitute an offer to purchase (by clicking the bidding button).
The highest bidder accepted by the auctioneer shall be the purchaser, unless
RESERVE or SUBJECT TO CONFIRMATION is applicable.
Sales Methods
All sales are done in one of the following manners:
NO RESERVE — “No reserve” means that there is no established minimum price for the item being auctioned. This means that no matter what the winning bid, the owner must sell it for that amount.
RESERVE — “Reserve” means a minimum price that must be attained for the bid to be accepted. If no bid equals or exceeds the reserve price, the goods may be withdrawn from the auction. This will be mentioned in the description of the lot.
SUBJECT TO CONFIRMATION (STC) — “STC” means that the owner must accept or reject the bid after finalization of the auction. The seller has two business days to accept or reject the offer. No bid may be withdrawn after the fall of the hammer until the expiry of the confirmation period. During this time, the offer shall be open for acceptance by the seller, and if accepted, the sale shall be deemed to be a sale by auction. This will be mentioned in the description of the lot.
All items are sold “voetstoots”, without any guarantees or warranties given by Tag Flow Auctions or the seller. The purchaser shall be deemed to have thoroughly examined the items and accepted the condition and state thereof. Tag Flow Auctions shall not be liable for any minor errors in description of any items. (All goods may be viewed on a Saturday from 08h00 to 14h00. Also refer to FAQ and Returns Policy.)
The auctioneer shall have the right to control, regulate, and record the auction. The recording of the auction shall be prima facie evidence of the auction proceedings. Both the bidders’ record and vendor roll are available for inspection during normal business hours after the auction has concluded.
The auctioneer may accept or reject bids at his sole discretion without providing reasons. This includes rejecting an offer previously accepted. In the event of a dispute between bidders, the auctioneer will have the discretion to re-auction the lot, and the decision shall be final and binding.
The auctioneer may, without penalty or prior notice, withdraw any item from auction at any time before or during the auction. The auctioneer reserves the right to extend bidding time should last-minute bidding occur.
No “ringing” or “collusion between buyers” shall be permitted. If suspected, the auctioneer may suspend or terminate the auction or prohibit those bidders from further participation.
The auctioneer is entitled to correct any bona fide error in the conduct or conclusion of any sale. If the error cannot be corrected, the auction shall be deemed not to have taken place, no party shall have claims against Tag Flow Auctions or the seller.
A sale by auction is complete when the auctioneer announces its completion by the fall of the hammer or any customary manner.
Tag Flow Auctions reserves the right to activate bidding extension to ensure fair bidding opportunities.
Tag Flow Auctions endeavours to maintain accessibility to the site 24 hours a day, 7 days a week. However, due to maintenance, updates, technical difficulties, server overload, or poor signal, Tag Flow Auctions cannot be held liable for system downtime. Should this occur near the end of an auction, Tag Flow Auctions will attempt to resolve the matter as quickly as possible but cannot be held liable for not winning a bid.
Risk on each item passes to the purchaser on the fall of the hammer, even though upliftment/delivery has not taken place. The purchaser bears risk for items remaining at Tag Flow Auctions premises.
Payment of Goods Purchased
LIVE AUCTION — Full invoice amount must be paid to Tag Flow Auctions during or directly the auction by card, or instant EFT.
ONLINE AUCTION — Full invoice amount must be paid to Tag Flow Auctions no later than 72 hours after the conclusion of the auction by EFT Collection of Goods
The purchaser shall remove purchases no later than 14 days after the auction, and only after payment clearance.
After 14 days, a storage fee of R30 per day will be charged.
Goods not collected within 30 days will be resold to cover storage costs.
Tag Flow Auctions does not deliver or arrange for a courier service, it remains the buyer’s
responsibility to arrange the courier services and payments.
The purchaser regards these terms and conditions as binding, irrespective of whether they were present at announcements. Special terms and conditions may be announced prior to or during the auction.
